The Brandaxo Compact: Terms of Service

This isn't legalese buried in a drawer. It's the clear, mutual understanding that keeps our gaming ecosystem stable, fair, and fun for everyone—from indie devs to competitive players. Effective as of January 2026.

Core Principles & Mutual Responsibilities

We host, you play. Here’s how we both uphold the ecosystem.

1

Your Conduct

You retain ownership of your content, data, and mods. However, by uploading to Brandaxo, you grant us a non-exclusive, worldwide license to host, distribute, and showcase that content within our ecosystem. You agree not to create or distribute content that is illegal, infringes third-party rights, or contains malware. Any harassment, hate speech, or cheating tools will result in immediate account termination. Your feedback, however, is owned by you—we only get to use it if you choose to share it publicly.

2

Our Stewardship

We provide the platform, infrastructure, and community tools. We are not a publisher, publisher, or marketplace for most user-generated content; we are a host. This means we do not vet, test, or guarantee the quality, safety, or functionality of any game or mod uploaded by third-party developers. Your use of any content is at your own risk. We do, however, commit to maintaining uptime, moderating reported violations of these terms, and providing clear channels for dispute resolution. We do not sell your personal data. Period.

Common Pitfalls (And How to Avoid Them)

Terms of service violations often stem from misunderstandings, not malice.

"I thought I could just repurpose assets."

Re-uploading another creator's art, code, or music without explicit permission or a compatible license (like MIT for code) is infringement. Always check the original author's terms, or create your own.

"My game includes a fan-art mode."

Using copyrighted characters (e.g., from a major franchise) without a license is risky. Even for 'homage' or 'parody,' legal thresholds are high. Stick to original IP or established open-source art packs.

"I didn't know the mod had a virus."

As a developer, you are responsible for the integrity of your upload. Distributing malware, even unintentionally, violates our terms and could have legal repercussions. Scan all build artifacts.

Scenario: The Asset Misstep

Alex, an indie developer, creates a beautiful tactical shooter for Brandaxo. He needs a specific ambient sound for a key level. After a quick search, he finds a 'royalty-free' pack on a third-party site, uses a sound, and uploads his game.

Two months later, he receives a takedown notice. The 'free' pack was unlicensed, and the original creator filed a claim. Our platform, per DMCA obligations, must temporarily remove Alex's game while the dispute is resolved. His reputation suffers; players are confused.

The Lesson: Due diligence isn't optional. Before using any third-party asset, verify its license directly on the source site. Document the license. In our ecosystem, ownership clarity is your most important armor.

> Did you read the full license agreement for that asset? If not, stop and verify.

Method Note

This document is a living agreement. We evaluate its robustness not by static clauses, but by its real-world application. When a dispute arises, our priority is transparent resolution over rigid enforcement. We prioritize user safety and creative freedom, but uphold legal integrity. All clauses are stress-tested against common gaming scenarios: modding workflows, asset pipelines, and competitive integrity. We reserve the right to update terms, with changes communicated via email and site notification. This is not a contract of limitation, but a framework for trust.

Evaluation Criteria for Enforcement
  • Severity of violation (e.g., malware vs. accidental copyright use)
  • History of compliance (first offense vs. repeat offender)
  • Intent (willful misconduct vs. genuine mistake)
  • Impact on community safety or system integrity
Inherent Trade-offs
Open Uploads Increase content variety but raise moderation burden.
Strict Vetting Ensure safety but stifle indie creativity and speed.
